Egyptian Civil Aviation Regulation (ECAR)
Part 107 provides the security requirements related to Egyptian Airports. This regulation is derived from the standards
and recommended practices of ICAO Annex 17, the Egyptian Civil Aviation Security
Program, the Airport Security Program (ASP) and the Airline Operator’s Security
Program. Changes or modifications to any
of these programs may have related changes to the other programs.
107.1 Objective and applicability
Each Airport Operator shall have as its
primary objective the safety of passengers, crew, ground personnel and the
general public in all matters related to safeguarding against acts of unlawful
interference with civil aviation.
(a) This Part prescribes aviation security rules governing:
(1)
The domestic and international operation of each airport regularly serving
scheduled passenger operations of a certificate holder required to have a
security program by Part 108.101, the Egyptian Civil Aviation Security
Program and the Airport Security Program
(ASP);
(2)
The operation of each airport regularly serving
scheduled passenger operations of a foreign air carrier required to have a
security program;
(3)
Each person who is in or entering a sterile area on
an airport described in paragraph (a)(1) or (a)(2) of this section;
(4)
Each person who files an application or makes
entries into any records or report that is kept, made, or used to show
compliance under this Part, or to exercise any privileges under this Part; and
(5)
Each airport operator that receives a Security
Directive or Information Circular and each person who receives information from
a Security Directive or Information Circular issued by the Egyptian Civil
Aviation Authority (ECAA).
(b) Except as provided in 107.105, the authority of
the ECAA under this may be further delegated.
For purposes of this Part the following definitions
are applied:
(a) “Airport
operator” means a person that operates an airport serving an aircraft operator
or a foreign air carrier required to have a security program under ECAR Part
108 .
(b) “Air
Operations Area (AOA)” means a portion of an airport, specified in the airport
security program, in which security measures specified in this part are carried
out. This area includes aircraft movement areas, aircraft parking areas,
loading ramps, and safety areas, for use by aircraft regulated under ECAR Part
108, and any adjacent areas (such as general aviation areas) that are not
separated by adequate security systems, measures, or procedures. This area does
not include the secured area. “Air side” means the movement area of an airport,
adjacent terrain and buildings or portions thereof, access to which is
controlled.
(c) “Escort”
means to accompany or monitor the activities of an individual who does not have
unescorted access authority into or within a secured area or SIDA.
(d) “Exclusive area” means any portion of a
secured area, AOA, or SIDA, including individual access points, for which an
aircraft operator or foreign air carrier that has a security program under Ecar
Part 108 has assumed responsibility under 107.111.
(e) “Law enforcement officer” means an individual
who meets the requirements of 107.215.
(f) “Sterile
area” means an area to which access is controlled by the inspection of persons
and property in accordance with an approved security program.
(g) “Background
Check.” A check of a person’s identity and previous experience, including any
criminal history, where appropriate, as part of the assessment of an
individual’s suitability for unescorted access to a security restricted area.
(h)
“Cargo.” Any property carried on an aircraft other
than mail, stores and accompanied or mishandled baggage.
(i) “Screening.” The application of technical or
other means which are intended to identify and/or detect weapons, explosives or
other dangerous devices which may be used to commit an act of unlawful
interference.
(j) “Security.” A
combination of measures and human and material resources intended to safeguard
civil aviation against acts of unlawful interference.
(k) “Security
Control.” A means by which the introduction of weapons, explosives or other
dangerous devices which may be utilized to commit an act of unlawful
interference can be prevented.
(l) “Security
Restricted Area.” Airside areas of an airport into which access is controlled
to ensure security of civil aviation. Such areas will normally include, inter
alia, all passenger departure areas between the screening checkpoint and the
aircraft, the ramp, baggage make-up areas, cargo sheds, mail centers, airside
catering and aircraft cleaning premises.
(m) “Unidentified
Baggage.” Baggage at an airport, with or without a baggage tag, which is not
picked up by or identified with a passenger.
(n) “Regulated
Agent.” An agent, freight forwarder or any other entity who conducts business
with an operator and provides security controls that are accepted or required
by the appropriate authority in respect of cargo, courier and express parcels
or mail.
(o) “Airport
security program” means an airport operator's security program required under
107.101 and approved by the ECAA
(p) “Airport
tenant” means any person, other than an aircraft operator or foreign air
carrier that has a security program under Ecar Part 108, that has an agreement
with the airport operator to conduct business on airport property.
(q) “Airport
tenant security program” means the agreement between the airport operator and
an airport tenant that specifies the measures by which the tenant will perform
security functions under 107.113.
(r) “Exclusive area agreement” means an agreement
between the airport operator and an aircraft operator or a foreign air carrier
that has a security program under Ecar Part 108 that permits such an aircraft
operator or foreign air carrier to assume responsibility for specified security
measures in accordance with 107.111.
(s) “Secured
area” means a portion of an airport, specified in the airport security program,
in which certain security measures specified in this part are carried out. This
area is where aircraft operators and foreign air carriers that have a security
program under Ecar Part 108 enplane and deplane passengers and sort and load
baggage and any adjacent areas that are not separated by adequate security
systems, measures, or procedures.
(t) “Security
Identification Display Area (SIDA)” means a portion of an airport, specified in
the airport security program, in which security measures specified in this part
are carried out. This area includes the secured area and may include other
areas of the airport.
(u) “Unescorted
access authority” means the authority granted to individuals by an airport
operator, aircraft operator, foreign air carrier, or airport tenant authorized
under this part or Ecar Parts 108 to gain entry to, and be present without an
escort in secured areas and SIDA's.
(v) “Air side”
means the movement area of an airport, adjacent terrain and buildings or
portions thereof, access to which is controlled.
107.5 Airport Security Manager (ASM)
(a)
Each airport operator shall designate one or more
Airport Security Manager(s) (ASM) in its security program. The designation
shall include the name of the ASM, and a description of the means by which to
contact the ASM on a 24-hour basis.
(b)
To serve as an ASM , a person must:
(1)
Have a university degree;
(2)
Be English proficient;
(3)
Be qualified with approved basic and advanced security courses and a specialist
course;
(4)
Have at least 12 years experience in
aviation security;
(5)
Have studies in technical, managerial, and security subjects;
(6)
Have at least 5 years experience in a supervisory position with overall
understanding of how to establish and manage a comprehensive security programme
and have a complete knowledge of all security-related functions;
(7)
Be of sound mind and body and a good personality;
(8)
Have the ability to make proper decisions in different circumstances; and
(9)
Receive approval from the ECAA.
(c)
The ASM shall serve as the airport operator’s
primary and immediate contact for security-related activities and
communications with ECAA, as set forth in the Airport Security Program. Any
individual designated as an ASM may perform other duties in addition to those
described in this paragraph.
(d)
The ASM shall be a member of the Airport Security
Committee and provide a record of meetings and measures taken by the committee.
(e)
The ASM shall continually monitor the airport
security status and ensure timely increases or decreases in security
preparedness in order to meet local conditions and security threats.
(f)
The ASM shall review with sufficient frequency all
security-related functions to ensure that all are effective and in compliance with
this part, its security program, and applicable Security Directives.
(g)
The ASM shall Immediately initiate corrective
action for any instance of non-compliance with this part, its security program,
and applicable Security Directives.
(h)
The ASM shall Review and control the results of
employment history, verification, and criminal history records checks required
under 107.209.
(i)
The ASM shall Serve as the contact to receive
notification from individuals applying for unescorted access of their intent to
seek correction of their criminal history record with the Police.
(j)
After January 1, 2004 , No airport operator may
use, nor may it designate any person as, an ASM unless that individual has
completed approved subject matter training, as specified in its security program,
to prepare the individual to assume the duties of the position. The airport
operator shall maintain ASM training documentation until at least 180 days
after the withdrawal of an individual's designation as an ASM.
(k)
An individual's satisfactory completion of approved
initial ASM training required under paragraph (i) of this section satisfies
that requirement for all future ASM designations for that individual, except
for site specific information, unless there has been a two or more year break
in service as an active and designated ASM.
(a) For purposes of
security inspections, each airport operator shall allow Special Agents
designated by the ECAA, at any time or place, to make any inspections or tests,
including copying records, to determine compliance of an airport operator,
aircraft operator, foreign air carrier, indirect air carrier, or other airport
tenants with part 108 and any security program approved under this part.
(b) At the request of the ECAA, each airport
operator shall provide evidence of compliance with this part and its airport
security program, including copies of records.
(c) The ECAA Inspectors may
enter and be present within secured areas, AOA's, and SIDA's, without access
media or identification media issued or approved by an airport operator or
aircraft operator bur only with access media or identification media issued by
the appropriate security authority, in order to conduct investigations,
inspect, test compliance, or perform other such duties as the ECAA may direct.
No
person may make, or cause to be made, any of the following:
(a) Any fraudulent or intentionally false statement
in any application for any security program, access medium, or identification
medium, or any amendment thereto, under this Part;
(b) Any fraudulent or intentionally false entry in
any records or report that is kept, made, or used to show compliance with this
Part, or exercise any privileges under this Part; or
(c) Any reproduction or alteration, for fraudulent
purpose, of any report, record, security program, access medium, or
identification medium issued under this Part.
107.11 Security responsibilities of employees and other persons
(a) No person may:
(1) Tamper or interfere
with, compromise, modify, attempt to circumvent, or cause a person to tamper or
interfere with, compromise, modify, or attempt to circumvent any security
system, measure, or procedure implemented under this part;
(2) Enter, or be present
within, a secured area, AOA, SIDA or sterile area without complying with the
systems, measures, or procedures being applied to control access to, or
presence or movement in, such areas; or
(3) Use, allow to be used,
or cause to be used, any airport-issued or airport-approved access medium or
identification medium that authorizes the access, presence, or movement of
persons or vehicles in secured areas, AOA's, or SIDA's in any other manner than
that for which it was issued by the appropriate authority under this part, or
ECAR Part 108 .
(b) The provisions of paragraph
(a) of this section do not apply to conducting inspections or tests to
determine compliance with this part authorized by:
(1) The ECAA; or
(2) The airport operator,
aircraft operator, or foreign air carrier, when acting in accordance with the
procedures described in a security program approved by the ECAA.
107.13 Airport security committee
Each airport operator shall arrange for the
establishment of an airport security committee at each airport serving
international civil aviation to assist the ASM in its role of coordinating the
implementation of security controls and procedures as specified in the airport
security programme, and for the purpose of coordinating security activities
with the National Civil Aviation Security Committee, departments, agencies and
other organizations of the State, airport and aircraft operators and other
entities concerned with or responsible for the implementation of various
aspects of the national civil aviation security programme.
